This agreement is provided for review only. During onboarding, you will receive the final version of the Broadcaster Agreement to review and sign if you agree with it.

INDEPENDENT BROADCASTER/MODEL/PERFORMER CONSENT AND AGREEMENT

This Agreement is entered into on August 19, 2026 between the broadcaster (hereinafter referred to as "Independent Broadcaster", "Model", or "Performer") and Tropistream Corporation, N.V., owner and operator of Cam4.com (hereinafter referred to as "Cam4" or the "Platform").

EGC. The Platform facilitates the creation and sharing of live streaming video, static pictures, and similar content. All such material submitted to the Platform and any such material submitted by you as an Independent Broadcaster pursuant to this Agreement, is referred to herein as "Entrepreneurial Generated Content" or "EGC".

As more fully described in the Platform's Terms and Conditions (the "Terms"), Independent Broadcaster has chosen to enter into this Agreement in order to be able to broadcast live streaming EGC, post static images and videos, and receive tokens from other Cam4 Users.

Independent Broadcaster acknowledges and agrees that if Cam4 or its affiliates are made aware of, or suspect, conduct which violates law, Cam4's Terms and Conditions, or the Rules of this Agreement, or which otherwise reflects negatively on the reputation and quality of Cam4 or its affiliates, Cam4 may, in its sole discretion, suspend or deactivate Independent Broadcaster's user account and/or ban Independent Broadcaster from the Platform. Independent Broadcaster further acknowledges and agrees that Cam4 may report any illegal activity or content submitted by Independent Broadcaster to local law enforcement as Cam4 deems appropriate in its sole discretion.

For the avoidance of doubt, the Company's core business is the operation, maintenance, and administration of the Platform, and the Company is not in the business of producing or distributing "cam shows." Independent Broadcaster acknowledges and agrees that the Platform enables Independent Broadcaster to directly license and otherwise distribute Content to Cam4 Users who elect to view Independent Broadcaster's Content, and that the Company is not responsible or liable for the actions or inactions of a Cam4 User in relation to Independent Broadcaster's Content. Independent Broadcaster shall be solely responsible for any obligations or liabilities to Cam4 Users or third parties that arise from Independent Broadcaster's creation, performance, or exhibition of Content.

AGE. Independent Broadcaster represents and warrants that the date of birth provided by Independent Broadcaster to Cam4 is true and correct and that Independent Broadcaster is at least eighteen (18) years of age or the age of majority in Independent Broadcaster's geographic location, whichever is higher (the "Age of Majority"), and that Independent Broadcaster's date of birth is true and correct on the government-issued ID submitted to Cam4 by Independent Broadcaster. Independent Broadcaster further warrants that all current identification information provided to Cam4 is a valid government issued identification bearing Independent Broadcaster's true and correct signature, is not expired, and shows Independent Broadcaster's true date of birth along with a recognizable photo of Independent Broadcaster.

DATA PROTECTION AND PRIVACY: Use of the Platform, including the creation, upload, streaming, and sharing of Entrepreneurial Generated Content ("EGC"), is primarily based on the contractual relationship established between you as an Independent Broadcaster and CAM4, as set out in the terms accepted at account creation and confirmed through continued use of the Platform. This contractual basis (including, where applicable, Article 6(1)(b) of Regulation (EU) 2016/679 ("GDPR") and equivalent provisions in other applicable data protection legislation) supports the processing of personal data that is strictly necessary to provide the services of the Platform. Such processing includes, without limitation, hosting and displaying EGC, enabling user interactions, facilitating viewer access, administering revenue mechanisms (including allocation and distribution of Tokens), implementing moderation and safety controls, and ensuring compliance with legal and regulatory obligations.

Independent Broadcaster acknowledges that the creation, upload, streaming, and distribution of EGC may involve the processing of personal data, including images, audiovisual recordings, voice data, online identifiers, and any other information that directly or indirectly can identify a natural person, in accordance with applicable data protection and privacy laws. Such laws may include, where applicable, the GDPR, the UK GDPR and the Data Protection Act 2018, the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA/CPRA"), and other national, state, or international data protection legislation relevant to the jurisdiction of the Independent Broadcaster.

CAM4 acts as an independent data controller for personal data processed in connection with the operation of the Platform. To the extent consent is required under applicable law for specific categories of processing, including the publication and distribution of EGC containing personal data, the Independent Broadcaster provides explicit, informed, and unambiguous consent to such processing by submitting EGC to the Platform and entering into this Agreement. When processing is based on contractual necessity or other legal bases (such as legitimate interests or compliance with legal obligations), CAM4 will rely on those legal bases as set out in its Privacy Policy. The purposes of processing include operation, distribution, marketing, moderation, syndication, sublicensing, and monetization of EGC, as further specified in this Agreement and in the Platform's Privacy Policy (available at https://www.cam4.com/legal/privacy and incorporated herein by reference).

Independent Broadcaster retains all rights granted under applicable data protection laws, including, where applicable, rights to access, rectification, erasure, restriction of processing, objection, data portability, and the right to withdraw consent at any time where processing is based on consent, without affecting the lawfulness of processing carried out prior to such withdrawal. For individuals subject to U.S. state privacy laws, including CCPA/CPRA, Independent Broadcaster may also have the right to know or access collected personal data, request deletion, opt out of the sale or sharing of personal data, and exercise rights against discrimination, as further described in the Privacy Policy.

CAM4 will process personal data in accordance with applicable data protection laws and will implement appropriate technical and organizational measures to ensure a level of security appropriate to the risks associated with the processing.

RULES. Cam4 has established the following rules to assure compliance with applicable law and Cam4 Terms and Conditions, and to protect the safety of Independent Broadcaster and Cam4 Users. Accordingly, Independent Broadcaster agrees to adhere to the following Rules while performing Content for Cam4 Users:

• Independent Broadcaster will adhere to the Cam4.com Terms and Conditions at all time broadcasting.
• Independent Broadcaster is free to create, perform, and exhibit EGC on Cam4 at any time or no time at all, or otherwise appear on other websites or platforms in addition to Cam4.
• Independent Broadcaster will not present as anyone being younger than the Age of Majority in their community. In the event Independent Broadcaster suspects that a Cam4 User believes Independent Broadcaster is younger than the Age of Majority, Independent Broadcaster will immediately correct the error by informing the User that Independent Broadcaster is of the Age of Majority.
• No third parties are allowed on camera with Independent Broadcaster unless such third party has signed a separate independent broadcaster agreement with Cam4.
• Independent Broadcaster shall not reveal Independent Broadcaster's real name, personal contact information or location to other Cam4 Users while performing Content.
• In the event a Cam4 User requests Independent Broadcaster perform an act he/she feels is in violation of this Agreement, Cam4 Terms and Conditions, or applicable law, Independent Broadcaster will cease to perform and will report to Cam4 Customer Service.
• Independent Broadcaster shall not participate in or simulate any acts involving child molestation or child pornography.
• Independent Broadcaster shall not participate in or simulate any obscene acts, including, but not limited to, necrophilia, bestiality, rape, urination, defecation or any other obscene and/or prohibited acts as found at Cam4 Terms and Conditions.
• It is strictly forbidden for the Independent Broadcaster to advertise or promote any entity, product, service, or website that delivers live-streaming content.

LICENSE GRANT TO CAM4. By distributing your content through our Platform, you hereby grant CAM4 a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, prepare derivative works of, display, and broadcast (live stream) the content in connection with our service including, without limitation, to promote and redistribute part or all of the CAM4 Site (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each User of the CAM4 Site (or any such alternate or additional media formats or channels) a non-exclusive license to access your content through the Site, and to use, display and perform such content as permitted through the functionality of Cam4 and under this Agreement. The above licenses granted by you are perpetual and irrevocable. Independent Broadcaster agrees to execute any and all reasonable documentation requested by Cam4 to perfect the rights granted herein.

This license expressly includes the right for CAM4 to share, distribute, syndicate, sublicense, or otherwise make EGC available to its subsidiaries, parent companies, affiliated entities, and authorized commercial partners for purposes consistent with the operation, marketing, monetization, promotion, and distribution of the Platform and related services.

By entering into this Agreement and signing it electronically, the Independent Broadcaster expressly acknowledges and agrees to such sharing and distribution of EGC with Cam4's affiliated companies and partners as described herein. You also hereby grant each user of the CAM4 Site (and any alternative or additional media formats or channels) a non-exclusive license to access your content via the Site, and to use, display, perform, stream, and download such content as permitted through Cam4's functionality and under this Agreement.

This license grant expressly includes your consent to be depicted in EGC via CAM4, your consent to your EGC being uploaded and made publicly available on CAM4's website and related distribution channels, and your consent for users to view, stream, download, and lawfully use your EGC according to the Platform's functionality and this Agreement. The above licenses and consents granted by you are perpetual and irrevocable.

PAID CONTENT. Subject to Cam4's Terms and Conditions, Independent Broadcaster may create certain EGC, such as static photographs or videos, available for purchase by Cam4 Users.

SHARED ACCOUNTS. If an Account has more than one Cam4 Member on it, the Member who created the Account is the owner of the Account and retains control over it. Any material changes must be done via primary email address associated with the Account.

FAN CLUBS. Subject to Cam4's Terms and Conditions, Independent Broadcaster may create and administer a fan club whereby Independent Broadcaster may provide certain Cam4 Users with access to exclusive EGC in exchange for payment of a set monthly membership fee determined by Independent Broadcaster.

REPRESENTATIONS AND WARRANTIES. Independent Broadcaster:

• has read, understands and agrees to be bound by the Cam4 Terms and Conditions, and understands that he or she exercises sole control over when or if he or she shall access the Platform and broadcast Content, and
• understands he or she is not obligated to appear on the Platform at any time, that Independent Broadcaster is free to appear on other web sites and platforms, and
• understands and agrees that he or she retains full control of his or hers use of the Platform, including ensuring that such use at all times conforms with applicable local, state and federal law, as well as the Cam4 Terms and Conditions, including but not limited to its Prohibited Images/Activities mandates, and
• acknowledges and agrees that all EGC content is for the benefit of Cam4 Users and not Cam4, and
• warrants to Cam4 that EGC will not infringe upon any intellectual property rights of third parties or otherwise violate any laws in the location in which the content is performed or exhibited, and
• agrees that if Independent Broadcaster appears on camera with any third party as permitted by this Agreement, Independent Broadcaster does so at Independent Broadcaster's own risk.
• acknowledges and agrees that human trafficking and sex trafficking and physical abuse are prohibited on CAM4.
• understands and agrees that if Cam4 may determines, at its sole discretion, that Independent Broadcaster has violated applicable law, violated a third party's rights, or has otherwise violated this Agreement, Cam4 has the right to immediately terminate this Agreement and cancel Independent Broadcaster's Account, and in such event Independent Broadcaster agrees to forfeit any remaining tokens provided by Cam4 Users to Independent Broadcaster's Account.

INDEMNIFICATION and RELEASE. Indemnity is your obligation to pay us for losses you cause by your actions using our Platform. You hereby agree to indemnify, defend and release Cam4, its affiliates and insurers and their respective officers, directors, employees, agents, successors and assigns, to the maximum extent permitted by applicable law, against any claims and losses (including reasonable attorneys' fees and costs), arising out of 1) your use of our Platform that violates the law, this Agreement or Cam4 Terms and Conditions, 2) your interaction with any Member, participation in any on-site experience or use of services or content provided by Independent Broadcasters, including, but not limited to, any prejudice, loss or damage (compensatory, direct, incidental, immaterial or other) of any kind arising in connection with or following the use of the Cam4 site in the broadest sense, 3) your failure to accurately report, collect or remit taxes, or 4) your violation of any law or any regulation or third party right such as intellectual property rights or confidentiality, right of publicity, invasion of privacy, sexual harassment, defamation, claims arising under the Family Medical Leave Act (FMLA), the Equal Pay Act (EPA), the Employee Retirement Income Security Act (ERISA), or the Age Discrimination in Employment Act (ADEA), injuries (both physical and emotional), negligence, intellectual property, claims relating to disease or illness, including sexually transmitted diseases, pregnancy, and any other claims under federal, state, local, or foreign law that may be legally waived and released. (The identification of specific statutes is for purposes of example only, and not to limit the scope of this general release.) Indemnity creates an obligation on your part to protect us and it is a material inducement for us to provide the Platform for your use. This defense and indemnification obligation will survive these Terms and your use of our Platform.

WAIVER OF CIVIL CODE SECTION 1542. California Civil Code § 1542 provides:

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN [THE CREDITOR'S] FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY [THE CREDITOR] MUST HAVE MATERIALLY AFFECTED [THE CREDITOR'S] SETTLEMENT WITH THE DEBTOR.

After consulting with counsel, or choosing not to consult with counsel after having an opportunity to do so, Independent Broadcaster hereby waives any and all rights and benefits conferred by the provisions of California Civil Code §1542 and any similar law of any state or territory of the United States or other jurisdiction. Independent Broadcaster acknowledges that this waiver is a material inducement for entering into this Agreement and that the Company would not have entered into this Agreement in the absence of this waiver.

LIMITS OF LIABILITY. CAM4 AND ITS AFFILIATES SHALL NOT BE LIABLE UNDER OR RELATED TO THIS AGREEMENT FOR ANY OF THE FOLLOWING, WHETHER BASED ON CONTRACT, TORT OR ANY OTHER LEGAL THEORY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES: (i) ANY INCIDENTAL, PUNITIVE, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR OTHER INDIRECT DAMAGES OF ANY TYPE OR KIND; OR (ii) INDEPENDENT BROADCASTER'S OR ANY THIRD PARTY'S PROPERTY DAMAGE, OR LOSS OR INACCURACY OF DATA, OR LOSS OF BUSINESS, REVENUE, PROFITS, USE OR OTHER ECONOMIC ADVANTAGE, EXCEPT FOR THE COMPANY'S OBLIGATIONS TO DISBURSE ANY AMOUNTS DUE TO INDEPENDENT BROADCASTER PURSUANT TO THIS AGREEMENT, BUT SUBJECT TO ANY LIMITATIONS OR OTHER PROVISIONS CONTAINED IN THIS AGREEMENT WHICH ARE APPLICABLE THERETO. NOTWITHSTANDING ANYTHING IN THIS AGREEMENT TO THE CONTRARY, COMPANY'S LIABILITY UNDER THIS AGREEMENT SHALL AT ALL TIMES AND IN THE AGGREGATE BE LIMITED TO $500.

ARBITRATION and CLASS ACTION WAIVER. Any dispute between Independent Broadcaster and Cam4 or any of Independent Broadcaster's or the Company's affiliates arising under, out of, in connection with, or in relation to this Agreement which cannot be resolved by negotiation or mediation must be submitted to binding arbitration administered by the American Arbitration Association pursuant to its then-current commercial arbitration rules and procedures. Any arbitration must be on an individual basis and the parties and the arbitrator will have no authority or power to proceed with any claim as a class action or otherwise to join or consolidate any claim with any other claim or any other proceeding involving third parties. The arbitration must take place in Curaçao. The arbitrator must follow the law and not disregard the terms of this Agreement. A judgment may be entered upon the arbitration award by the Court in Curaçao. The decision of the arbitrator will be final and binding on all parties to the dispute, however, the arbitrator may not under any circumstances: (i) stay the effectiveness of any pending termination of this Agreement; (ii) assess punitive, exemplary, or consequential damages; (iii) make any award which extends, modifies, or suspends any lawful term of this Agreement or any reasonable standard of business performance that the Company sets; (iv) modify, abrogate or rescind this Agreement; or (v) enjoin or restrain in any way the production, distribution or advertising of the Content. The arbitrator, and not a court, shall have exclusive authority to resolve any dispute over the enforceability of all or any part of this section. In the event that any one or more provisions of this Arbitration and Class Action Waiver shall be or become invalid, illegal, or unenforceable in any respect, the validity, legality, and unenforceability of the remaining provisions of this section shall not be affected thereby.

SEVERABILITY. If any provision or portion of this Agreement is held to be invalid or otherwise unenforceable, such provision or portion shall be interpreted to fulfill its intended purpose to the maximum extent permitted by applicable law, or if legally impossible, such provision or portion shall be ineffective only to the extent of such invalidity, and the remainder of this Agreement will continue in full force and effect.

TERMINATION. This Agreement may be terminated by either party for any reason whatsoever and shall be effective upon delivery of written notice as follows:

By Independent Broadcaster's electronic signature on this Agreement, Independent Broadcaster hereby represents, covenants, and warrants that Independent Broadcaster has the ability to grant all rights granted herein, and that there are no agreements or other legal impediments which render or may render Independent Broadcaster's acceptance of this Agreement invalid, unlawful or avoidable.

Independent Broadcaster agrees that this Agreement is intended to be governed by the Electronic Signatures in Global and National Commerce Act (the "E-Sign Act") and that by typing my name below, I intend it to stand in the place of a manual signature and be equally as binding on Independent Broadcaster as if Independent Broadcaster had signed this document manually. Independent Broadcaster has the right to withdraw Independent Broadcaster's consent to using the E-Sign Act by emailing the Platform at support@Cam4.com at which time Independent Broadcaster will immediately cease using the Platform; provided however that Independent Broadcaster understands and agrees that the withdrawal of Independent Broadcaster's consent herein shall apply only as of the date of such withdrawal and will not affect Independent Broadcaster's previous unrestricted grant of rights to Cam4, if any, with respect to Content performed prior to the date of such withdrawal.
